On Justifying Israeli Military Action

“There seems to be an over-reliance on mens rea arguments in order to somehow lay equal blame at the feet of both Hamas and the IDF. Even in criminal law, though, intent is nothing without action; you can think about hideous serial murder all day long, but unless you actually act on it, you can’t be legally arrested for being a sociopathic weirdo. To deflect attention away from the 1000+ civilian deaths inflicted by the IDF over the past couple of weeks by focusing on what Hamas may or may not do given the means is to ignore real crimes for imaginary future crimes.

Again, this does not take guilt away from Hamas for their very real actions; attacking civilians is inexcusable when either side does it. It just so happens that right now, one side seems to be doing quite a lot more of it than the other, and it is having very real consequences on very real people.”
